“Dismiss NRM Faridah Nambi’s Petition” Electoral Commission Asks Court

Must read

The Electoral Commission has asked the High Court to dismiss a petition filed by Nambi, challenging the results of a recent parliamentary election. The Commission argues that even if there were any irregularities, they were not significant enough to impact the final outcome.

Speaking to Uganda Radio Network, the Commission’s Head of Litigation, Eric Sabiiti, revealed plans to submit additional evidence to strengthen their case.

“We’ve reviewed the petition and supporting affidavits and filed our statutory response. Soon, we will present further evidence to prove the petition lacks merit,” Sabiiti said.

In her petition, Nambi levels several allegations against the elected MP, Nalukoola, claiming that he and his agents engaged in voter manipulation and election malpractice.

Nambi accuses Nalukoola of campaigning on election day at the Kazo Angola (KAL-KZ) LCI Office polling station, where he allegedly told voters, “amaanyi g’abantu temugalyaamu olukwe,” a Luganda phrase loosely translated as “do not betray People Power.”

She further claims that Nalukoola’s agents, Kibirige Musa and Nabakooza Ritah, campaigned at Bright Sparks Junior School polling center by displaying his campaign posters and urging voters to support him.

In addition, Nalukoola is accused of violating section 90 of the Parliamentary Elections Act by obstructing voters. Nambi names several of his agents and campaigners—including Bukenya Bonny, Hon. Balimwezo Ronald Nsubuga, Sserunjogi Edward, and others—alleging they prevented people like Nassanga Deborah from voting at Kalanda’s Compound polling station.

According to Nambi, results from at least 14 polling stations, representing approximately 16,640 votes, were never officially announced. These stations include Mbogo Primary School Playground, various locations in Kazo Angola, and Bosa’s Road.

She also alleges that Nalukoola engaged in voter bribery. Among the claims:

He gave UGX 10,000 to Kyemba Muwanguzi Nathan at one of the contested polling stations.

His agent, Ben Ntale Mukasa, allegedly gave UGX 5,000 to Mawumbe George William near a shrine at Ouma’s place in Kiganda Zone to sway his vote.

Nalukoola reportedly gave another UGX 5,000 to Wamukubira Geoffrey at Pentecostal Church polling station to secure his vote.

Nambi asserts that these acts were committed by Nalukoola directly or by his agents with his consent. As such, she is asking the court to nullify the election results and order a by-election.

The High Court has not yet scheduled a hearing, as it awaits responses from all parties. Nalukoola is expected to file his reply soon, having recently assembled a legal team comprising nine law firms to defend his victory.
