In a shocking case at the Grade One Magistrates Court in Mwanga II, Kampala, a mother named Namugga Prossy was sent to Luzira Prison after she failed to produce her son, Tumwine Moses, in court. Namugga had stood surety for her son in a trespassing case at Rubaga Miracle Centre, promising that he would appear in court for his trial.

As part of her obligation, she signed a non-cash bond of Shs20 million. However, Tumwine disappeared, prompting the court to issue a warrant for his arrest. Because of this, the court held Namugga accountable, leading to her remand in prison.

The case dates back to 2023, when Tumwine was arrested for allegedly disturbing the peace of Pastor Robert Kayanja at Rubaga Miracle Centre Cathedral. At that time, Namugga stepped in as her son’s guarantor, trusting him to follow the legal process. Unfortunately, he went missing, leaving his mother to face the consequences.

This incident highlights the serious responsibilities of sureties in Uganda. Those who agree to act as guarantors must ensure the accused attends court, or they may face severe penalties, including imprisonment. Many people have expressed sympathy for Namugga, while others emphasize that accountability is crucial.

While law enforcement continues to search for Tumwine, Namugga remains in Luzira Prison as the court monitors the situation. The story raises important questions about the balance between enforcing legal obligations and protecting family members who are caught in difficult situations.
