Nakawa Magistrate’s Court has denied bail to Alex Waiswa Mufumbiro, who is currently facing charges of incitement to commit an offence. This decision came despite the court acknowledging that all the sureties presented on his behalf were substantial. The denial of bail marks another legal hurdle for Waiswa, who also faces a separate charge of unlawful drilling at Kawempe Magistrate’s Court in Kanyanya.
In response to the court’s ruling, Waiswa has remained defiant and resolute, urging supporters and the public to continue pressing on despite what he describes as persecution. His determination shows a commitment to his political ambitions, even in the face of legal setbacks.
Undeterred by the court proceedings, Waiswa has proceeded with his political engagements. He was recently seen heading to Mbuya 1 for the official launch of his campaign for the Nakawa East Constituency parliamentary seat. This move signals his readiness to continue connecting with constituents and advancing his political vision, emphasizing that legal challenges will not derail his mission to serve the people.
In his ruling, the Magistrate agrees that the sureties presented are substantial since the prosecution did not raise any objections to that effect.
The Magistrate stated that the court is alive to the fact that the accused has a right to bail, bearing in mind the rule of presumption of innocence until proven otherwise.
However, given that the applicant is a top official in one of the biggest opposition political parties @NUP_Ug in the country, it is likely that the applicant might use his influence to interfere with investigations. Therefore, the applicant should temporarily be kept on remand while his defence team advocates for a speedy trial.
The Magistrate went ahead to advise the defence team to apply for bail after investigations are completed. He also directed the state to expedite investigations.
Observers note that Waiswa’s situation highlights the growing tension between political ambition and legal scrutiny in the region. His supporters remain optimistic that his resolve and persistence will carry him through these challenges, demonstrating resilience in the face of adversity.
