Ex NSSF Boss Byarugaba Sues Gender Minister over Job Renewal

Former NSSF Managing Director Richard Byarugaba has lodged a petition with the High Court's Civil Division, challenging the decision to not renew his contract. Byarugaba is requesting the Court to order the Minister of Gender, Labour, and Social Development, Betty Amongi, to fulfill her legal obligation and reinstate him as NSSF's Managing Director, as recommended by the Board and required by law.

Byarugaba contends that the decision to reject the Board's recommendation for his reappointment was procedurally flawed, lacking a fair hearing, and violating his legitimate expectations.

Evidence presented shows that Byarugaba had been in the role since August 1, 2010, with his second term ending on November 30, 2022. He asserts that Minister Amongi attempted to prematurely terminate his contract before its completion, citing his age of 60. Byarugaba emphasizes that the Attorney General's intervention allowed him to complete his second term.

Though the NSSF Board and Attorney General advised renewing Byarugaba's contract, Amongi only renewed the Deputy MD's contract and deferred Byarugaba's, citing various allegations. Byarugaba argues that Amongi's decision disregarded key reports clearing him of wrongdoing and was influenced by bias.

Byarugaba notes that stakeholders, directed by President Yoweri Museveni, met to conclude his appointment process, but Amongi did not comply. He emphasizes that ignoring the Parliamentary Select Committee's favorable report and the Inspector General of Government's findings further underlines the illegality and bias in not renewing his contract.

Byarugaba's application, filed by Byenkya, Kihiika and Company Advocates, awaits allocation to a Judge for the upcoming hearing. The NSSF, led by Byarugaba and his Deputy, has over 2 million members and assets worth 17 trillion Shillings.
