Our Client Is Under No Duty To Speak To You Regarding Your Dubious And Endless Investigations, Ssemakade Lawyers Write To The CID Commander.

City Lawyer Isaac Ssemakade has snubbed the Criminal Investigations Directorate Kampala Metropolitan police summons for case conferencing and fact-finding meeting on a case of alleged criminal libel vide CID headquarters GEF 312/2023 citing extra judicial and  violation of human rights.

Ssemakadde has however instructed his lawyers of GEM Advocates and legal consultants to write to CID Metropolitan Police indicating several reasons as to why he has been unable to attend the scheduled meeting.

In a letter, Spyreports managed to get a copy indicating that, Ssemakadde on 28 February 2022 reported to the police at Kibuli Vide CID headquarters GEF 136/2022 for the same purpose as the instant summons.

The letter further states that the allegations at issue were on the same day endorsed in the charge and summons issued by the Buganda Road Chief Magistrate Court vide SUW Criminal case No.257 of 2022 Uganda Verses Isaac Ssemakadde, at the instance of a private prosecutor requiring him to respond and attend before the presiding magistrate Marion Mangeni on 4th March 2022.

''The said case was last mentioned on 22 february 2024 and adjourned to 25th March 2024 for further management ''. The letter reads.

Ssemakadde's lawyers added that police summons for the case conferencing and fact-finding not only constitute an extra-judicial inquiry in breach of the sub judice Rule but also violate their client's Article 28(3)(a) rigjhts as interpreted by the constitutional court in Olara Otunnu vs the Attorney General petition No.12/2010, a decision which expressly limited police powers under section 27A of the Police Act.

Now the lawyers added that Ssemakadde can not speak to the police on this matter and advised police to attend court on 25 March this year 2024.
