Bizarre! Dead Person Sells Land To City Tycoon Kiruma

The Consul of Namibia in Uganda, Godfrey Kalule Kirumira bought land from a dead person, the court heard.

According to Liberty ICD Limited, Kirumira, a businessman, owns a kibanja agreement, showing that he bought the disputed land from a person who died 21 years ago.

This case which was filed in 2021, three years ago at Mukono High Court but Kirumira has been opening several Court Applications relating to the same land, with Liberty perceiving this clearly a delaying tactic.

In October 2021, Kirumira attempted to make a way to Plot 393 Block 113 through Liberty ICD Limited’s land, prompting the company to lodge a criminal trespass case against Kirumira at Namanve Police Post and Seeta Police Station, respectively.However, when Police intervened, Kirumira claimed that this land was a Kibanja, despite it being private property designated for industrial use by the Government.

Police also discovered recently that plot 393 has also been created under a new block 561 and there are now two blocks 561 in the same area; Furthermore, Police found there are now three titles for plot 393, which is criminal act.

FRAUD

Court documents indicate, Kirumira made the disputed Kibanja agreement with Yokana Galikwoleka Mukasa on October 30, 2017. 

However, NIRA records indicate that Galikwoleka died on July 20, 1996.A Forensic Report made at Police headquarters Naguru shows the thumbprint on the kibanja agreement belongs to Steven Muwonge, hence a criminal offence.

 Police also found that the entire agreement was prepared by Muwonge. Upon interrogation, Muwonge revealed he was Kirumira’s employee and that he and his colleagues witnessed the signing of the kibanja agreement at Jokas Hotel, Kampala, in November 2021 on the instruction of Andrew Mubiru, who is Kirumira’s close associate.

POLICE REPORT

According to Police, Kirumira’s kibanja agreement does not indicate a landlord, ownership history, boundary, measurements and payment of busuulu tickets. It is on this basis that Liberty ICD contends this kibanja agreement, not valid and Kirumira is wasting court’s time.

To discover the details of the kibanja, police resolved to open its boundaries but Kirumira stopped it and filed a case against four senior police officers. 

They are; Kampala East Regional Commander Anatoli Katungwesi, Police legal director Erasmus Twaruhukwa, Mukono Police Commander Edirisa Kyeyune and Namanve Police Station boss Norah Akide.

This case is on appeal before the Court of Appeal after High Court judge David Matovu rejected lawyer Francis Ssebbowa’s averments that the Attorney General has no powers to represent the police officers in the matter.

The judge agreed with Senior State Attorney Mark Muwonge that the Attorney General is mandated under the law.At this juncture, Andrew Mubiru, Kirumira Associate then sued 13 investors operating at Namanve Industrial Park, saying they are occupying a forest reserve.

However, in 2022, Justice David Batema, ruled that the certificates of titles for land in Namanve Industrial Park were issued legally. 

This was concurred by the Commissioner Land Registration, who also agreed Namanve CFR does not exist.The judge’s ruling renders the letter National Forestry Authority (NFA) addressed to Mubiru, on April 29, 2022, as not legally valid.

Justice Matovu will on May 15, 2024 deliver a ruling in the case of Andrew Mubiru filed against the 13 Investors and 4 Government Institutions.

DPPPolice investigations show that offences of criminal trespass and forgery have been committed in regard to the case of kibanja and plot 393 block 113.

 It also indicates that Kirumira paid a stamp duty of sh1.2m instead of sh550m (a massive undervaluation) when he transferred land title of Plot 393 Block 113 to his name, which is a Criminal Act, according to Liberty ICD and verified by the Government Valuer.

Kirumira, however, contends possession of plot 393 block 113 after CVIL, the registered proprietor, failed to service strictly only a bank loan of sh400m and not for purchase.COMPLAINT Liberty ICD says that despite Andrew Odiit, the Director of Public Prosecutions (DPP) in charge of Land Crimes Department, on August 22, 2023 consenting to charges of forgery, criminal trespass and fraudulent transfer of the land title of plot 393 block 113, after a six-month investigation by various Police departments, George Byansi, the Deputy DPP in charge of Inspections, Quality Assurance, Research and Training, in a letter dated February 20, 2024, revoked the decision, saying the matter lacks merit without consulting with any of the Investigating Officers. 

This was after receiving a letter from Legal Counsel for Kirumira, Vennie Murangira Kasande. Which Liberty ICD has appealed Byansi’s decision

CRIMINAL AND FRAUDULENT SUMMARY

To date Consul Kirumira has a Criminal Case for illegal trespassing on Private Property, fraudulent Kibanja agreement, buying Kibanja from a dead person, illegally transferring a land title when there was only a loan agreement, creating a New Block 561 out of thin air, onto of exixting Block 113, thereby creating 3 Plots 393 in the same area, influencing Deputy DPP Officer Byansi to withdraw Criminal charges at DPP.

SKIPPNG COURT

Since the case started, Kirumira has never attended court session in Mukono High Court.

 The presiding judge Matovu has asked Kirumira’s lawyer Ssebbowa on this but there is no response. According to Liberty ICD Limited, Kirumira, consul of Uganda to Namibia keeps calling himself an Ambassador thinking he can be immune and evade justice. Court resumes 17th may 2024 .
