Lands Minister Sam Mayanja, Kyankwanzi RDC Clash OVer Legal Land Eviction Order, Rubbishes Court Ruling Gives Land To Wrong Person


The State Minister in charge of Lands Hon Sam Mayanja is now in total battle with RDC of Kyankwanzi District Sharon Akunda over effecting lawful land eviction order, Spyreports has learnt.

The under panic Minister Mayanja on Friday stormed Kyankwanzi district with his tight security, rubbished Court ruling and eviction order and gave out land to wrong person. 

The even which has now exposed Minister Mayanja as a biased man was shown on local Televisions and is now circulating on all social media platforms. Minster Mayanja using his powers allocated land to one Fausitine Ntambala who has never bought or owned land in the said area.

Genesis of tthe land
According to the court documents and ruling which we obtained copies show that around 2021, Nankya Harriet, Namubiru Prissy and Namiiro Zulaika  as Plaintiffs entered into a land battle with Amina Namusisi Namiiro and Commissioner Land Registration as Defendants

The documents show that the battled land measured 620 hectares. The documents show that the land originally belonged to  late Labisoni Miiro but later died in 1976. Documents show that after his death, was left in the hands of his three biological daughters.

 "In 2017 the plaintiffs were granted letters of administration to manage their father's estate arising from a grant made by the family division of the high court," Reads part of the court documents.

The two parties battled the land matter in Mubende high Court and on 18/2/2021Hon Justice Isaac Muwata made his ruling in favor of the plaintiffs.

The Judge in ruling made the following orders,  a declaration that the defendant's registration on the suit land is null and void, An order to the commissioner land registration to cancel the names of 1st Defendant from the blue page and reinstate the names of Mirro Labisoni on the certificate of title comprised of Singo block 756 plot 18, An order to the commissioner of land registration the land on the blue page as unascertained portion of land in the names of Kate Mirro  Labisoni, An order directing the 2nd respondent to register the plaintiffs on the blue page of the late Miiro Labisoni and certificate of title into the names of the administrators of the estate, An order of nemeses profits totaling five million shillings, An order of eviction against the 1st  defendant, permanent injunction restraining the 1st defendant from dealing in the suit land,General damages of ten million shillings and the cost of the suit.

According to court documents which we further looked at, the defendants after losing the matter never appealed against the high court ruling.
It is under stood, after the plaintiffs won the matter decided to sell off their land and share the money. The land was later sold to one Mugabi Davis at the cost of shs 620m. "The agreements were made and witnessed of local Authorities," Says Mugabi when contacted on phone.

He added that the titles were also put into his names. Mugabi further says that around 2023, he also sold the same land to one Mr Julius Arinaitwe at the cost he did not reveal to us. Davis says before, Mr Ntambala had occupied part of his land after he had fully bought it. "When he forcefully encroached on my land,I went to court and applied for an eviction which was granted to me.

RDC Sharon Speaks  Out
When contacted RDC Sharon Akunda on phone after watching the whole saga, she says that she was appointed by the President to be the RDC of Kyankwazi in July 2022. " when I got into the office, I found two court orders on my table one was for plot 18 and 19," She says during a telephone interview.She added that all plots of land were occupied by One Ntambala Fausitine. RDC Says she called all the two parties that claimed the land for the meeting in her office.

The party that accused Ntambala produced all the relevant documents indicating that they owned the land but Ntambala failed to produce even a single document, "Reveals RDC Sharaon. She adds that after verifying the documents produced by one party, she called District Security Committee(DSC) to verify the Court order. She says the DSC was attended RDC as Chair, DISO, DPC, OCID, CI, LCV CAO and Other Investigators. "We all found out that the court order was okey and genuine and it passed in all procedures and we effected it," Says the RDC. She adds that eviction took place and there was no chaos at all and it is now almost one year plus.


Minister Mayyanja Comes
The RDC says around  early April this year, Minister Mayanja wrote to me a letter saying he wants to make locus meeting on the land comprising of block 758 plot 1 measuring approximately 4 square meter and is in the names of Kyeyune Rwembaho Bosco and is located in Bukuta village, Rwengiri LC1 Kyankwanzi District. "I told him that the land he is mentioning does not exisit," Sounds RDC.


Ministter visits the  Land.
The RDC adds that on 2nd May, Minister and his team came to Kyankwanzi to visit the land and before they went on the actual land, they held a preparatory meeting at my office and was attended  Minister him self, RDC,RPC, R/CID, DPC,LCV ,DISO among others. She says that during their meeting, they all a agreed of protecting the court order.

 She also said Ntambala wanted the meeting to be held where eviction took place because he had mobilised goons and I rejected as security head. "We held the meeting in a neutral place and I chose a small group that met the Minister," Says RDC saying they inspected the land.

RDC says that Minister told the small group that since there is no another court order canceling the old one, we shall hand over the land to its original owners and they all accepted.

 Then they went to address the main gathering. "We all gave our remarks as agreed before and we gave the land to original owners," She says.


NTAMBLA'S Lawyer Interveins.

The RDC says as they were concluding, lawyer Jet Tumwebaze who represents Ntambala who also comes from  Minister's law firm where Ntambala has been a client for over 20 years came up with a police report which was never there before and the security team had no copy and knowledge about it.

Miniser Changes Side.
The RDC reveals to us that after the lawyer read the police report which they need to verify, the Minister changed his mind and temper and supported Mr Ntambala.

 "We all got shocked how the Minister changed like a chameleon and supported the person who has never appeared any where in the land matter," she says adding that who ever tried to advise the Minister was abused.

 "At the end of the day,Minister became the judge and gave out the land to a wrong person and even ordered for the arrest of Davis," she said adding that his ruling sparked off violence where properties were damaged and people beaten including pregnant woman who got a miscarriage.
