Museveni Pardons Former NSSF Boss David Jamwa, Nine Others .
President Yoweri Kaguta Museveni has pardoned David Chandi Jamwa, the former Managing Director of National Social Security Fund (NSSF).
“In the exercise of the power vested in me under article 121 (1) (a) of the constitution of the republic of Uganda, 1995 as mended and on the advice of the advisory committee on the prerogative of mercy, I hereby grant to the person below, on public health and humanitarian grounds,” president Museveni’s letter reads in part.
The prisoners who benefited from the president’s prerogative of mercy are: David Chandi Jamwa, Vincent Ntale, Nelson Drabo, James Omirambe, Samuel Aliama, Francis Leku, Joseph Kabila, Yoha Ayitia alias Samu, Fred Kato and Jackson Owino.
David Chandi Jamwa was indicted by the High Court on two counts namely: Abuse of office c/s 11 of the Anti-Corruption Act, 2009 and Causing financial loss c/s 20 of the same Act respectively. He was tried and convicted of the offence of causing financial loss but was acquitted of the offence of abuse of office. He was then sentenced to 12 years imprisonment and barred from holding any public office for a period of 10 years after serving the sentence. He appealed to the Court of Appeal against the conviction and sentence. He also appealed to the Court Appeal against the acquittal. The two appeals were consolidated by the Court of Appeal. His appeal to the Court of Appeal was dismissed. He was instead sentenced to 4 years imprisonment for the offence of abuse of office which was to run concurrently with the 12 years imposed by the trial judge for the offence of causing financial loss.
The Supreme Court in 2019 cancelled the bail which had been granted to Jamwa and reaffirmed a 12-year jail term handed to him by the Anti-corruption Court in 2011 for causing a 3.1 billion shillings loss to the Fund in 2007.
President Museveni using the "Instrument of Power as the head of state has pardoned Jamwa and nine other inmates.
